The "baby-bust" generation, or Prostitution is illegal in the vast majority of the United States as a result of state laws rather than federal laws. It is, however, legal in some rural counties within the state of Nevada. Additionally, it is decriminalized in the state of Maine. Prostitution nevertheless occurs elsewhere in the country.The regulation of prostitution in the country is not among the enumerated powers of the federal government. It is therefore exclusively the domain of the states to permit, prohibit, or otherwise regulate commercial sex under the Tenth Amendment to the United States Constitution, except insofar as Congress may regulate it as part of interstate commerce with laws such as the Mann Act.In its original form, the act made it a felony to engage in interstate or foreign commerce transport of "any woman or girl for the purpose of prostitution or debauchery, or for any other immoral purpose". Its primary stated intent was to address prostitution, immorality, and human trafficking, particularly where trafficking was for the purposes of prostitution. It was one of several acts of protective legislation aimed at moral reform during the Progressive Era. In practice, its ambiguous language about "immorality" resulted in it being used to criminalize even consensual sexual behavior between adults.
